MAC MEMBERSHIP TERMS AND CONDITIONS

These Terms and Conditions:

  1. may be changed by MAC from time to time; and
  2. are subject to the terms of the Constitution. To the extent of any inconsistency between the two the Constitution will prevail.

Becoming a member

A person becomes a Member when MAC accepts their application and they have paid the relevant subscription.

By becoming a Member of MAC, you become a member, by affiliation, of Multiples NZ Incorporated.

Ceasing to be a member

A person ceases to be a Member when:

  1. they resign their membership in writing to a representative of the Committee (such as the president or membership officer) or by ceasing their membership via their account on MAC’s website; or
  2. their membership is terminated by MAC on other grounds as contemplated in the Constitution.

A Member’s resignation of membership will be effective from the date it is received unless another date is specified in the resignation.

In the event of termination by MAC, the effective date for a Member’s membership to cease will be determined in accordance with the Constitution.

A person who has ceased to be a Member:

  1. remains liable to pay all subscriptions and other fees to MAC’s next balance date,
  2. shall cease to hold themselves out as a Member of MAC,
  3. shall return, at MAC’s request, all material provided to Members by MAC (including any equipment), and
  4. shall cease to be entitled to any of the rights and benefits of a Member.

Subscriptions

All Members are entitled to a full 12 months’ subscription from the date of joining MAC. A Member’s subscription for the following year shall then become due on the 12 month anniversary of their membership.

Subscriptions are subject to change in accordance with the process outlined in the Constitution.

Subscriptions are non-refundable except in certain circumstances as determined by the Committee.

Member benefits

A Member may only exercise the rights of membership (including attending and voting at General Meetings), and access the benefits provided by MAC, if all subscriptions and any other fees have been paid by their due dates.

MAC may add, modify or remove any benefit, content, service or event at any time, regardless of whether it has provided advance notice to Members of the change.

The benefits of membership shall extend to a Member’s family, unless people within a family indicate that they wish to hold separate individual memberships.

Members may be asked to provide identifying details to confirm their membership to access benefits.

Member obligations

Every Member shall provide MAC in writing that Member’s name and contact details (namely, physical or email address and a telephone number) and promptly advise MAC in writing (for example by updating their details in their account on the MAC website) of any changes to those details.

No Member shall represent or hold themself out as a representative of MAC, or purport to act on behalf of MAC or use the name of Multiples Auckland Central or the initials of that name or any insignia or symbol adopted by MAC without the prior written consent of the Committee.

  1. No Member is liable for an obligation of MAC by reason only of being a Member.

Disputes

Any dispute or difference between a Member and MAC or between Members of MAC shall be dealt with in accordance with the Constitution.

Limitation of liability

To the fullest extent permitted by law, MAC will not be liable (in negligence, tort, breach of contract or otherwise) for any direct or indirect loss, or special or consequential loss, arising out of or in connection with a member’s membership of MAC or the provision (or non-provision) of Member benefits.
